This End User License Agreement (“Agreement”) is between you and Jarnaljit Singh (the “Developer”, “we”, “us”), and governs your use of the Famlok application (the “App”). This Agreement applies in addition to our Terms of Use and Privacy Policy. If there is any inconsistency about the license to use the App, this Agreement applies.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices that you own or control, for your personal, non-commercial use, in accordance with this Agreement, the Terms of Use, and the usage rules of the app store you obtained the App from.
You must not: copy (except as permitted), modify, translate, reverse-engineer, decompile or disassemble the App; rent, lease, lend, sell or sublicense it; remove proprietary notices; or use it unlawfully or in breach of the Terms of Use.
The App offers an optional auto-renewing subscription, Famlok Guardian (product ID famlok_guardian_monthly), currently US$9.99 per month, or the local-currency equivalent, with a one-month (30-day) free trial. Pricing, free-trial, renewal and cancellation terms are set out in section 4 of the Terms of Use and are managed through your app store account. No card details are provided to the Developer; Apple or Google processes all payments.
Our handling of your information, including the third-party services and international data transfers involved, is described in the Privacy Policy. You may delete your account at any time from within the App: Profile → Settings → Delete Account. This permanently deletes (does not merely deactivate) your account and associated data; it cannot be undone. If you cannot access the App, you may request deletion by emailing support@famlok.online from your account email.
Profile photos and bug-report uploads: Images and log files stored with our media host (Cloudinary) are not automatically deleted when you delete your account, because uploads are unsigned and the App holds no media-host secret. To have them permanently removed, email support@famlok.online with your account email.
The App is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain rights, so some of the above may not apply to you. Nothing in these terms limits or excludes any guarantee, warranty, or right you have that cannot be limited or excluded under the law that applies to you, including the mandatory rights of consumers in the European Economic Area, the United Kingdom, Australia, California, and other regions. Where such rights apply, they operate in addition to these terms.
Famlok is not a replacement for emergency services — in an emergency, contact your local emergency number (for example 911 in the United States, 112 in the EU/UK, 000 in Australia, or the number for your country) and emergency services directly.
Alerts and locations are best-effort and may be delayed, inaccurate, incomplete, or undelivered (depending on battery, operating-system background limits, connectivity, GPS, and device settings). Do not rely on Famlok for emergencies or safety-critical decisions; you remain responsible for your own safety and for supervising any child or vulnerable person.
To the extent permitted by law, our total liability arising out of or relating to the App is limited to the greater of (a) the amounts you paid for the App in the 12 months before the claim or (b) USD 50, and we are not liable for any indirect, consequential, incidental, or special damages. This Agreement is governed by the laws of California, United States, without regard to its conflict-of-laws rules.
Nothing in this section limits any non-excludable rights or protections you may have under the mandatory consumer-protection laws of your own country, state, or region (including, where applicable, consumers in the European Economic Area, the United Kingdom, Australia, and California). Where local law gives you rights that cannot be waived by contract, those rights prevail over any conflicting term in this agreement.
The safety information, dispute-resolution and liability provisions in the Terms of Use also apply to this Agreement.
You represent and warrant that you are not located in, and will not use the App in, a country or region subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You must comply with all applicable export-control, sanctions and other laws, and with any applicable third-party terms.
The following additional terms apply if you obtained the App from the Apple App Store:
If you obtained the App from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this Agreement and is not responsible for the App. The Developer, not Google, is solely responsible for the App and for addressing any claims relating to it.
