These Terms of Use (“Terms”) are an agreement between you and Jarnaljit Singh (“Famlok”, “we”, “us”, “our”), a US-based individual developer. They govern your use of the Famlok mobile application and related services (the “App”) on both Apple iOS and Google Android, worldwide. By creating an account or using the App, you agree to these Terms and to our Privacy Policy and End User License Agreement.

1. Eligibility and accounts
You must be at least 13 years old to create a Famlok account.
Children under 13 (United States / COPPA): a child under 13 may not create their own account. Where a child under 13 uses Famlok, collection of their information requires verifiable parental consent, and the parent or guardian who holds the account consents on the child’s behalf. A parent or guardian may review the child’s information, refuse further collection, and request deletion via support@famlok.online or through in-app account deletion.
Children under 16 (EEA) / under 13 (UK): where processing relies on consent, a parent or guardian must provide consent for a child below the applicable national digital-consent age. In the European Economic Area this age is 16 unless the relevant member state has set a lower age (which can be as low as 13); in the United Kingdom it is 13.
Younger children generally: a child below the account-creation age may use Famlok only on a parent or guardian’s own device, set up and supervised by that parent or guardian, with the parent’s consent.
When you create an account, you confirm a self-attestation checkbox stating: “I’m at least 13 years old. If I’m under 13, my parent or guardian has set up and consented to my use of Famlok.” This is a self-attestation only — Famlok does not collect a date of birth and does not verify age or identity.
You may hold one account, which is tied to a single device at a time (single-device login).
You are responsible for keeping your account secure and for activity that occurs under your account.
You must provide accurate information and keep it up to date.
2. What Famlok does
Famlok lets members of a family circle share their real-time location, saved places, drives and safety alerts with one another. It also provides SOS alerts, a fixed set of quick messages, and optional premium automated neighborhood-safety and local-news information. Features depend on your device, permissions, network and subscription, and may change over time.
3. Acceptable use & consent to be tracked
Famlok is for sharing location among consenting family members. You agree that you will not:
use Famlok to track, monitor or share the location of any person without their knowledge and consent (or, for a child in your care, without being their parent or legal guardian);
use Famlok for stalking, harassment, abuse, or any unlawful purpose;
add a person to a circle who has not agreed to be part of it;
attempt to disrupt, reverse-engineer, or gain unauthorized access to the App or its systems.
Only add people who have consented to being located. Tracking another person without their consent may be unlawful in your jurisdiction (for example, under surveillance, wiretapping, anti-stalking, or privacy laws) and may be a criminal offense. You are solely responsible for ensuring everyone you track has consented.
4. Subscription, free trial & billing
Famlok offers an optional auto-renewing subscription, Famlok Guardian (product identifier famlok_guardian_monthly), which unlocks premium features.
Price: a monthly subscription shown to you in your local currency in the App Store or Google Play before you confirm (currently US$9.99 per month, or the local-currency equivalent).
Free trial: a free trial is available to new subscribers (currently one month, no payment card required to start). If you do not cancel before the trial ends, it converts to a paid subscription. Any unused portion of a free trial is forfeited when you start a paid subscription.
Auto-renewal: the subscription renews automatically each period unless you cancel. Your store account is charged at confirmation of purchase and on each renewal.
How to cancel — you can cancel at any time:
iPhone / iPad: Settings → your Apple Account → Subscriptions → Famlok → Cancel. (Apple asks you to cancel at least 24 hours before renewal.)
Android: Google Play app → Profile → Payments & subscriptions → Subscriptions → Famlok → Cancel.
Cancellation takes effect at the end of the current paid period; you keep access until then.
Refunds: purchases are processed by Apple or Google, and their refund policies apply. This is in addition to any non-excludable consumer rights you may have under the law that applies to you (see section 5).
5. Consumer rights & warranties
The App is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain rights, so some of the above may not apply to you. Nothing in these terms limits or excludes any guarantee, warranty, or right you have that cannot be limited or excluded under the law that applies to you, including the mandatory rights of consumers in the European Economic Area, the United Kingdom, Australia, California, and other regions. Where such rights apply, they operate in addition to these terms.
6. Safety information & important limitations
Please read this section carefully. It explains what Famlok can and cannot do, so you can use it safely. This section is information about the service’s real-world limits — it does not take away any non-excludable rights described in section 5.
Famlok is not a replacement for emergency services — in an emergency, contact your local emergency number (for example 911 in the United States, 112 in the EU/UK, 000 in Australia, or the number for your country) and emergency services directly. Famlok is not a substitute for emergency services, security monitoring, or supervision of a child or vulnerable person. Do not rely on Famlok to summon help.
Location and alerts are “best-effort”. Locations, arrival/departure alerts, drive detection, SOS and other notifications depend on factors outside our control — including your phone’s battery, operating-system background limits, network coverage, GPS accuracy and device settings — and may be delayed, missed, inaccurate, incomplete, or not delivered.
Neighborhood safety estimates are automated and informational only. They are generated by artificial intelligence, may be inaccurate or out of date, and must not be relied on to make safety, travel, housing or personal-security decisions.
Drive scores and driving events are estimates generated automatically for family awareness. They are not suitable for, and must not be used for, insurance, employment, lending, legal, housing or similar decisions.
You are responsible for your own safety and for supervising any child or vulnerable person in your care. Always use your own judgment.
7. Liability
To the maximum extent permitted by law:
our total aggregate liability arising out of or relating to the App or these Terms is limited to the greater of (a) the amounts you paid for the App in the 12 months before the event giving rise to the claim, or (b) USD 50;
we are not liable for any indirect, consequential, incidental or special damages, or for loss of profits, data, goodwill, or for loss or damage that was not reasonably foreseeable;
we are not liable for matters beyond our reasonable control (such as device, operating-system, network or third-party-service failures), nor for the conduct of other members of your circle or other users.

8. Third-party services
The App relies on third-party services (including Apple, Google, Mapbox, Cloudflare, Cloudinary and others described in our Privacy Policy). Your use of those services may be subject to their own terms, and we are not responsible for them.
9. Intellectual property & license
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, in accordance with these Terms and the End User License Agreement. We (and our licensors) own all intellectual property in the App. You retain ownership of the content you provide, and you grant us the license necessary to operate the App and provide the features you use.
10. Suspension and termination
You may stop using Famlok and delete your account at any time from Profile → Settings → Delete Account. This permanently deletes (rather than deactivates) your account and data, and cannot be undone.
If you cannot access the App, you may request deletion of your account and data by emailing support@famlok.online from your account email address.
We may suspend or terminate your access if you breach these Terms or use the App unlawfully. Where it is reasonable and lawful to do so, we will give you notice and an opportunity to fix the problem first; we may act without prior notice where there is a serious or urgent issue (such as a risk to safety or to our systems).
If your subscription is active when your account ends, store refund policies and any non-excludable consumer rights you have continue to apply.
11. Changes to these Terms
We may update these Terms from time to time. We will post the updated version with a new “Last updated” date and, for significant changes, give you reasonable notice in the App or by other reasonable means. If you do not agree to a change, you can stop using the App and cancel your subscription. Continued use after a change takes effect means you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of California, United States, without regard to its conflict-of-laws rules. Subject to the arbitration provision below and to any non-excludable rights described in this section, you and we agree to the exclusive jurisdiction and venue of the state and federal courts located in that state.
Nothing in this section limits any non-excludable rights or protections you may have under the mandatory consumer-protection laws of your own country, state, or region (including, where applicable, consumers in the European Economic Area, the United Kingdom, Australia, and California). Where local law gives you rights that cannot be waived by contract, those rights prevail over any conflicting term in this agreement.
Arbitration and class-action waiver
To the extent permitted by the law that applies to you, you and we agree that any dispute arising out of or relating to the App or these Terms will be resolved by binding individual arbitration rather than in court, and that you and we waive any right to participate in a class, collective, or representative action.
30-day opt-out: you may opt out of this arbitration and class-action waiver within 30 days of first accepting these Terms by emailing support@famlok.online with your account email and a statement that you opt out. If you opt out, the rest of these Terms still applies.
Where it does not apply: this arbitration and class-action waiver does not apply where prohibited by the law that applies to you — including to consumers in the European Economic Area and the United Kingdom, and to anyone whose local law bars pre-dispute arbitration agreements or class-action waivers.
Nothing in this section limits any right you have to make a complaint to, or seek dispute resolution from, a regulator, supervisory authority, or data-protection authority where one exists in your country, state, or region.
