Haulbeam — Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Haulbeam ("Haulbeam", "we", "us", "our") governing your use of the Haulbeam iOS app (the "App"). Haulbeam is a truck-navigation app for use in Australia.

By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old and, where you use the App for driving, hold a current and appropriate driver's licence for the vehicle you operate. By using the App you confirm you meet these requirements.
2. Safety disclaimer — please read carefully
Haulbeam is a driver-assistance aid, not an authoritative source of truth, and not a substitute for your own judgement, road signage, or the law.
- Routing and restriction information is generated from third-party and community data (including HERE and OpenStreetMap). This data is incomplete and may be inaccurate or out of date. Low bridges, weight and dimension limits, road closures and other restrictions may be missing, wrong, or unsigned in the data.
- Crowd-sourced hazard and weighbridge reports come from other users and may be false, mistaken, or outdated.
- Voice recognition and automated command interpretation can make mistakes.
You are solely responsible for safely operating your vehicle and for complying with all road rules, signage, vehicle-dimension and mass limits, fatigue and chain-of-responsibility laws, and other regulations. Always obey roadside signage and lawful directions over anything shown in the App. Do not operate the App in a way that distracts you from driving safely. Only interact with the App when it is safe and lawful to do so.
You use the App and rely on its information at your own risk.
3. Licence to use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own use, subject to these Terms and the Apple Media Services / App Store Terms (Apple's standard Licensed Application End User License Agreement applies to the App).
4. Acceptable use
You agree not to:
- submit false, misleading, abusive, unlawful, or spam hazard reports, weighbridge reports, or chat messages;
- harass, threaten, or post personal/sensitive information about others;
- attempt to circumvent the free-trial limits, subscription, security rules, or device-trial protection;
- reverse-engineer, decompile, scrape, overload, or interfere with the App or its servers, or use it other than through the supplied interface;
- use the App for any unlawful purpose or in breach of these Terms.
We may suspend or terminate your access if you breach this section.
5. Your content
You retain ownership of the hazard reports, weighbridge reports, and chat messages you submit ("Your Content"). By submitting Your Content, you grant us a worldwide, royalty-free licence to host, store, reproduce, and display it to other Haulbeam users and to operate and improve the App. You understand that Your Content (and your display name) is shared publicly with other drivers and that we are not responsible for how other users use it. You are responsible for Your Content and confirm you have the right to submit it.
We may remove content that breaches these Terms, but we are not obliged to monitor or store content and may delete it (for example, weighbridge reports expire automatically — see the Privacy Policy).
6. Subscription, free trial, and payments
- Free trial. The App offers a 30-day free trial, limited to one trial per device. We use Apple's DeviceCheck to enforce this; reinstalling the App or using a different account does not reset the trial.
- Subscription. After the trial, continued use of paid features requires the Haulbeam Pro auto-renewable subscription at A$3.99 per week (the price shown in the App and on the App Store is authoritative).
- Billing & renewal. Payment is charged to your Apple ID at confirmation of purchase. The subscription auto-renews each week unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing & cancelling. You manage or cancel the subscription in your Apple ID / App Store settings. Deleting the App or your Haulbeam account does not cancel the subscription.
- Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. Requests for refunds are generally directed to Apple.
These subscription terms operate together with Apple's App Store terms.
7. Third-party services and attributions
The App relies on third-party services, each governed by its own terms, including HERE (mapping and routing), Google/Firebase (sign-in, database, messaging), Cloudflare (voice-command processing and trial protection), Cloudinary (support attachments), and Apple (sign-in, speech, payments, notifications).
Map and points-of-interest data is © OpenStreetMap contributors and is used under the Open Database License (ODbL). Safety-station, weighbridge and enforcement locations are compiled from OpenStreetMap and public government/agency communications and may be approximate. We are not responsible for the availability, accuracy, or content of third-party services.
8. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Australian Consumer Law (ACL) or other laws that cannot lawfully be excluded. Our goods and services come with guarantees that cannot be excluded under the ACL. Where we are permitted to limit our liability, the sections below apply to the extent allowed by law.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law (and subject to Section 8):
- The App is provided "as is" and "as available", without warranties of any kind, including as to accuracy, reliability, fitness for a particular purpose, or uninterrupted availability.
- We are not liable for any loss, damage, fine, penalty, injury, delay, vehicle or property damage, or other harm arising from your use of, or reliance on, the App or its data — including inaccurate routing or restriction information, false or missing hazard reports, voice-recognition errors, or service interruptions.
- To the extent our liability cannot be excluded but can be limited, our total liability is limited to the amount you paid us for the App in the 12 months before the claim, or (at our option) re-supplying the service.
10. Indemnity
To the extent permitted by law, you agree to indemnify us against claims, losses, and costs arising from your misuse of the App, your breach of these Terms, or content you submit.
11. Suspension and termination
You may stop using the App and delete your account at any time. We may suspend or terminate your access if you breach these Terms or to protect users or the service. Sections that by their nature should survive (including Sections 2, 5, 9, 10, and 12) survive termination.
12. Governing law and jurisdiction
Haulbeam is operated by a sole operator based in California, United States, and the App is offered for use in Australia.
- For users in Australia (all users): these Terms and your use of the App are governed by the laws of the Commonwealth of Australia, and nothing in these Terms limits your rights under the Australian Consumer Law (see Section 8).
- Provider's home jurisdiction: to the extent any matter is not governed by Australian law, or a dispute is brought in the United States, the laws of the State of California, USA apply.
The parties submit to the non-exclusive jurisdiction of the courts of Australia and of the State of California, USA — meaning a dispute may be brought in either, depending on the circumstances. The App is intended for use in Australia.
13. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date and, for significant changes, provide notice in the App. Continued use after an update means you accept the revised Terms.
